Federal Judge Orders Release of Salvadoran Deported by Trump Administration in Controversial Case

By National Correspondent | June 23, 2025

A Tennessee judge has ruled to release Kilmar Ábrego García, a Salvadoran deported under the Trump administration despite protected status, raising serious questions about government overreach and immigration enforcement errors.

The case of Kilmar Ábrego García highlights the troubling consequences of the Trump administration’s aggressive immigration policies. Deporting an individual who held a protected status was not merely a bureaucratic slip-up but an alarming example of government failure that undermines due process and legal norms.

On Sunday, Judge Barbara Holmes in Tennessee ordered Ábrego García’s release, rejecting the government’s motion to detain him further. The judge emphasized that Ábrego must receive the due process guaranteed by law — a safeguard that was clearly denied when he was unlawfully deported to El Salvador along with over 230 other immigrants.

This forced removal occurred on June 6th despite Supreme Court rulings and a Maryland judge confirming the deportation was illegal. Yet upon his return to the U.S., Ábrego faced new charges related to alleged human trafficking activities dating back to 2022.

The allegations stem from an encounter with law enforcement in Tennessee where Ábrego was traveling with several undocumented individuals. He pleaded not guilty during his first court appearance on June 13th in Nashville.

The broader context reveals a pattern of reckless enforcement tactics that put American legal principles at risk while inflaming social tensions. Hundreds gathered outside the courthouse protesting against ICE and demanding more humane immigration policies — reflecting public concern over these unjust actions.

Holding Government Accountable for Immigration Overreach

This case exemplifies how executive overreach threatens both individual rights and national credibility. Missteps like wrongful deportations erode trust in our justice system and compromise America’s sovereign ability to enforce laws fairly.

America First demands adherence to lawful processes without sacrificing security or fairness. The Trump administration’s error here spotlights institutional failures that must be corrected to restore integrity and protect citizens’ interests.
